- Advised on intellectual property and technology issues in connection with the multi-billion dollar acquisition of almost all of the international insurance business and one domestic division of a financial services company by another financial services company.
Patent Litigation
- Represented former senior scientist at Fortune 500 Company in dispute with former employer over scientists’ patent applications filed at new start-up company.
- Represented consumer products company in litigation with rival over patent technology.
Trademark Litigation
- Defended domain name and service mark holder that provided on-line stock market information and financial services to investment professionals. The dispute involved claims of consumer confusion and trademark infringement in violation of the Lanham Act.
- Defended $12 million Lanham Act (Trade Name Infringement) claims, obtaining dismissal at summary judgment.
- Prosecution of claims for and eventual award of injunctive relief preventing trade mark infringement for the owner of the United States rights to the Electrolux brand, a leading international home appliance franchiser.
Trade Secrets and Unfair Competition Litigation
- Successfully defended and resolved a complex commercial dispute in which the plaintiff claimed that the defendants converted confidential competitive information and engaged in unfair competition.
- Representing HVAC seller and installer in Lanham Act unfair trade practices claim against competitor selling inferior HVAC equipment with false advertising.
IP Licensing Litigation
- Represented American telecommunications and new media company in dispute over software licensing agreement with Mexican telephone company.
